Sažetak
The CDSM Directive introduced in the EU a new related right for press publishers on their press publications when they are used on the Internet by information society service providers (ISSPs). It was a long-prepared answer on the press publishing industry struggles in the digital environment, especially when it comes to the licencing their content. After the CDSM Directive came into the force, Member States encountered difficulties in the implementation of the new related right into their national legislation, especially with regard to its efficiency. The manner in which press publishers can enforce their right against information society service providers who are obliged to obtain a licence and pay royalties for using their content online is the crucial issue. So far, this was not successful unless competition law intervened to curb the BigTech’s practices. In this paper, the authors identify the main obstacles to efficiency in licensing schemes of press publishers’ right in the EU and analyse ways in which different Member States approached the implementation of the CDSM in their national legal systems, ranging from no special regime to the mandatory collective management.
