Sažetak
Law, including criminal law, rests on regulating human relationships and interaction reflecting desired social and ethical values. Human behavior is characterized by subjectivism, motivation, changes, feelings, affects, autonomy, physical presence, influences. Artificial intelligence is perceived and described as cold, lifeless, calculated, predetermined, unchanging, insensitive, stable, and inanimate. Therefore, it is understandable that its ability to fit into existing legal and social frameworks attracts so much attention and questioning. Some of the areas to consider in this lecture are definition of the concept of artificial intelligence, manners of establishing criminal liability depending on the type of artificially intelligent behavior, the possibility of harmonizing (principle of) culpability and (autonomous) decision-making in criminal law…The answers will give current views and positions on these issues discussed in the literature, as well as the latest developments and expressed positions in various acts regarding the position of AI in criminal law.
