Sažetak
What is bullying in the workplace? How to define mobbing and how to prove it? Finally, what do we do? Although the history of the mobbing is not long, its systematic study in the last few decades has brought many legal rules and law regulations around the world, not only to serve its prevention but every part of mobbing in most countries in EU is classified as a criminal offence for which a certain penalty is followed. In addition, mobbing leaves huge psychological consequences for the individual, so, such consequences are reflected on his family, organization, and society as a whole as well. Each employer shall protect its workers from any kind of abuse and should provide safety to each individual but also enable them professional development, which is an essential component of satisfaction and quality of working relationship. In Croatia, mobbing has been defined by Criminal Code of the Republic of Croatia (furthermore CC RC) as a crime against labor relation i.e. as criminal offence - Maltreatment at the work place, Art. 133. Para. 1. CC RC. According to data of the Croatian Bureau of Statistics just one convicted person was in 2020. Possible explanation for this lays in the fact that mobbing is very hard to prove. Beside this, it is important to mention the offence from Chapter 34 of the CC RC, Art 362 RC- Maltreatment of a Subordinate or a Military Person of Lower Rank.
