Sažetak
The paper, using the normative method, analyzes the legal framework of the current Act on International and Temporary Protection, to highlight the specifics of the implementation of a special administrative procedure in this administrative area. Emphasis is placed on the procedural-legal position of the parties in the procedure, deadlines for decision-making on the application, types of decisions made by the Ministry of the Interior when deciding on the application of an applicant for international protection (asylum) and other procedural elements. Numerous legal sources are briefly highlighted, which, in the Republic of Croatia, are important for issues such as asylum procedure, reception conditions, fundamental procedural rights of international asylum seekers, restriction of freedom of movement by accommodation in the Shelter for Asylum Seekers, Reception Center for Foreigners, etc. The importance of the legality of treatment should also be emphasized as well as the role of police officers (border police) who, especially in cases of irregular migration, are the first to contact the third-country nationals, asylum seekers. Furthermore, the legal mechanisms for ensuring legal protection of applicants seeking international protection (asylum) are presented. A special part of the paper is dedicated to the analysis of statistical data provided by the Ministry of the Interior (International Protection Service, Department for International Protection Procedure) and the Administrative Court in Zagreb through a tabular presentation of administrative and administrative- court practice in the observed period.
