Sažetak
The paper deals with the issue of correct employment status of people working through digital labour platforms. In relation thereto, the study examines the question of whether platform workers are in an employment relationship or self- employed persons who remain outside the scope of labour legislation. Through a comparative analysis of foreign case law, the issue of adequacy of the existing criteria used to differentiate between employment relationship and other contractual relationships, as well as the need to develop additional or adjust the existing indicators is considered. In – depth analysis primarily focuses on the following criteria for determining the employment status of platform workers: direction and control, obligation to work for a defined or minimum amount of time (i.e. working time flexibility) and organizational integration.
