Sažetak
Remissio mercedis is a legal concept originating in the Roman law of lease (letting and hiring, locatio conductio rei) whereby the tenant of a farm was entitled to the remission, reduction or the complete pardon of the rent payment in case the land and the crops were damaged or destroyed because of the floods, earthquakes, draughts, etc., in general the occurrences classified as the vis maior. The institution had been the object of reception during the Middle Ages and as a part of the Roman legal tradition was introduced in the first civil codes, French Code civil and Austrian ABGB. On the other side, German BGB did not envisage a separate provision for the rent abatement in similar cases, but the general rules on risk should apply. In the ex-Yugoslav (1978) and the modern-day Croatian Obligations Act from 2005, the middle approach was taken. It is said that the tenant has right to rescind a contract or ask for the rent abatement if the object of lease was partially destroyed or damaged, but there is no mention of the impaired enjoyment. In this paper it is investigated into the reasons and influences of Germanic private law systems, the doctrinal positions and the stances in judicial practice, which brought upon this position in Croatian law. Also, the comparative context of these influences is provided with the examples from several Central and Southeast European countries.
