Sažetak
The consent in marriage, in Roman law and in general, needs to be visible for the outside world and for the legal order. However, the concept of public declaration of marital consent is inherently fraught by the issues arising from the relationship between the (internal) will to enter into marriage and the expression of that will. It is investigated in the first part of this paper the attitudes and solutions of postclassical emperors, esp. Justinian, and the role of Christianity concerning the proof of marital consent and the creation of first presumptions in that context. Following that, it is elaborated on the medieval canon law jurists’ considerations of the issue. The study comprises the introductory remarks on the Decretum Gratiani and the Roman legal sources contained within, the positions of theologians concerning the declaration of marital will, and the decretals resolving pertinent cases. After laying down legal and religious foundations, the focus is placed on the positions of civilians and decretists on proving and establishing the marital consent and the presumptions used therefor.
