Sažetak
The issue of criminal protection of patients' rights in Bosnia and Herzegovina is very complex, given the specifics of the internal organization of the state. In order to talk about criminal liability and the application of positive regulations in the field of criminal legislation of Bosnia and Herzegovina, this paper analyses the de lege lata provisions of the existing legal framework governing patients' rights. The issue of ensuring patient health care in B&H is criticized for the lack of a single state law that will regulate the rights and obligations of patients in the same way, given that this area is within the competence of entity legal regulations. In addition to other forms of liability that come into consideration regarding violations of patients' rights, such as civil, misdemeanour and disciplinary, the focus of this paper is on the analysis of incriminations within B&H criminal law that protect patient autonomy as a special social category. Thus, the entity criminal laws in B&H regulate a special chapter of crimes against human health, which is mostly aimed at doctors and health professionals as perpetrators, but in a very uneven way.
