Sažetak
The subtle anti-arbitration policy of the European Union has a long history. It dates back to 2007 and the Lisbon Treat, which transferred to competence to conclude international agreements with Member States to the European Union, and reached its culmination in 2019 with the judgment of the EU Court of Justice in the Achmea case. The repercussions of that judgment are so great that today it is difficult to find a lawyer who does not know about the famous and controversial judgment of Achmea. Although both the advocate general and national courts of the Member States had different and thoroughly reasoned opinions, the Eu Court of Justice took a very firm stand and by this ruling de facto annulled all arbitration clauses in BITs within the EU. On the other hand, the CJEU has not offered an adequate alternative to invalid arbitration clauses, nor has it answered the question on how to compensate for the legal protection offered by the intra-EU BITs. Whit this article, the authors intend to explain how the Achmea ruling disrupted international investment market and why the abolished system was actually more favorable for investment.
