Sažetak
The prohibition of discrimination on any basis had its basis in the principle of equality, which is one of the fundamental principles of every civil society. The protection of persons with disabilities is one of the most sensitive areas of protection against discrimination, precisely because the rights of persons with disabilities are violated in practice, directly or indirectly. The paper will analyze the international, European and national legal framework for the protection against discrimination, followed by discrimination against persons with disabilities through lack of reasonable accommodation. Pursuant to Article 4, paragraph 2 of the Croatian Anti- Discrimination Law, discrimination will also be considered a failure to enable persons with disabilities, in accordance with their specific needs, the use of publicly available resources, participation in public and social life. This paper will present an analysis of reasonable accommodation in the Republic of Croatia in relation to Article 4 of the Anti-Discrimination Act. The first part of the research involved conducting analyses of international, European and positive regulations related to the prohibition of discrimination and discrimination on the basis of disability, as well as conducting a survey. The second part of the research covers the accessibility of state and cultural institutions in the Republic of Croatia to persons with disabilities as well as conducting interviews with representatives of the construction profession. The purpose of the research is to examine the level of accessibility of state and cultural institutions to persons with disabilities and to examine whether in practice the adaptation of such institutions is really impossible because they are located in buildings that have been declared cultural property. The results of the research will be presented in this paper.
