Sažetak
Consumer credit agreements in business-to-consumer relations (B2C) denominated or expressed in Swiss francs (CHF) have affected approximately 75, 000 Croatian consumers. The financial products were offered on the Croatian credit market prior to Croatia becoming an EU Member State in the estimated time period from 2003 to 2009. The presented Croatian case law and practice confirm that a number of these contracts were concluded by use of unfair commercial practices, violation of consumer credit rules, and insertion of unfair contractual terms. The latter concerns the variable interest rate and the so-called currency clause expressing the loan principle in CHF, both of which affect the essential elements of consumer credit contracts.
