Sažetak
As for the role of the supreme court, in Croatia there is a prevailing opinion, even in the leading textbooks on civil procedure, that the adjudication of the supreme court in the further appeal procedure, serves both the individual as well as the public purpose. Can a supreme court perfectly and completely fulfil both its individual as well as its public purposes? My response to this question would be - no. I am of the opinion that the position of the Croatian supreme court, somewhere in between individual justice and system management, is unsustainable. Furthermore, such a position is the main cause of the overload problem.
