Sažetak
Regulation 606/2013 and Directive 2011/99 were drafted on the assumption that protection orders can be procured either through civil and criminal law. Most Member States provide for both civil protection orders and criminal protection orders but there are variations, - in some MS civil protection orders are not available but protection orders can be obtained in either criminal or misdemeanour proceedings (Croatia), in some MS civil and criminal protection orders as such are not available (but ‘quasi-criminal’ - Finland, Denmark and Sweden). Hence not all systems fit neatly into the ‘civil vs criminal protection orders’ dichotomy envisaged by the EU legislator.- all Member States make it possible to impose three prohibitions set out in Regulation 606/2013 and Directive 2011/99: 1.) the ban on contacting the protected person 2.) the ban on entering certain areas 3.) the ban on approaching the protected person Despite many commonalities, there are also important procedural variances in procedures of issuing a protection order across the Member States.
