Sažetak
In this presentation, the history of competition law in Croatia is presented through the three research outputs based on the empirical research study conducted in 2018. The overall topic of this historical legal research is the development of competition systems in post-socialist countries, using Croatia as a case study, including detecting the main challenges for its optimal evolution. All the parts of the 'triptych' are based on an extensive dataset (most importantly, original in-depth interviews with key stakeholders in Croatia). The central part of the research deals with identifying key development phases of the Croatian competition system (the mid-1990s until 2018), as well as detecting key underlying issues/problems (this paper is forthcoming in the Journal of Antitrust Enforcement in 2021). The second paper deals with the impact of national culture on the competition system, and the issue of informal governance (published in World Competition, March 2021, with my Ruzica Simic Banovic). Finally, the third paper deals with the issue of authoritarian legal culture legacy, excessive formalism in judicial interpretation and semantic dissonance in the application of competition rules (working paper for the Loyola University Institute for Consumer Antitrust Studies, 2021).
