Sažetak
The language of the law is generally perceived as accurate, precise, neutral, complex and ambiguous, and often incomprehensible for laypeople. The author aims to prove that poetic figures constitute another significant feature of the language of law in Western cultures. As an illustration, numerous examples are used from English and German languages, supported by several examples in Swedish, Polish, and Croatian. In the introduction, general features of the language of law are discussed, and the main goal of the paper determined. In the theoretical part, the archaic elements and rituality of English and German customary laws are analyzed as a historical foundation of poetic elements that are still present in legal language. The main part is dedicated to different types of poetic figures present in the English language of the law, which are then compared with similar stylistic figures in the German language. Several examples are offered in both languages to illustrate that almost all poetic figures can be found in these legal languages: alliteration, assonance, accumulation, antithesis, anaphora, cataphora, ellipsis, euphemism, hyperbole, personification, tautology… Special attention is paid to metaphor and metonymy as two phenomena of the language of the law, that have been a subject of several linguistic discussions in recent years. In the final part of the paper, the author draws conclusions and gives recommendations for further research.
