Sažetak
The Rome I Regulation provides rules on the law applicable to contractual obligations and the Rome II Regulation provides rules on the law applicable to non-contractual obligations. Since the Croatian accession to the European Union on 1 July 2013, the Rome I and Rome II Regulations take precedence over national conflict-of-laws rules that coincide with their scope of application. For the purpose of the Regulations’ transitory provisions, the date of Croatia’ s accession is treated as the day of the entry into force of the Regulations. The chapter provides an overview of the Croatian case law on the application of the two Regulations as well as a comparative view of the new rules and the rules that were in force before the Croatian accession to the EU.
