Sažetak
After describing main characteristics of the Adriatic Sea, the chapter provides analysis of the legal framework of its environmental protection on multiple levels: global, regional, sub-regional, national and local. On the global level, there are several IMO conventions dealing with prevention, response and liability for marine pollution but the most important international treaty is the 1982 United Nations Convention on the Law of the Sea (UNCLOS), considered an “umbrella convention” because of the provisions contained in its Part XII. As for the regional level of marine protection in the Mediterranean, its legal regime was developed in accordance with the principles of the 1972 Stockholm Declaration of the United Nations Conference on the Human Environment. The Barcelona Convention together with its related Protocols constituted the legal framework for the regional cooperation in the Mediterranean basin, including a program for pollution monitoring and research. Croatia, Slovenia, Montenegro and Bosnia-Herzegovina as the four independent coastal states created after the dissolution of former Yugoslavia have become parties to the most important international treaties dealing with the law of the sea. In the meantime, their national legislation codified not only the maritime law but also the law of the sea, incorporating many provisions from those international conventions. Now their strategic task is to develop sub-regional co-operation with Italy and Albania and create common strategy for the protection of the sensitive environment of the Adriatic Sea. On the national and local level, the best approach for this protection is through the integrated management of coastal zones.
