This contribution provides a brief critical overview of the evolution of the concept of undertaking in EU competition law and its implications for national social security institutions. This notion is central for the application of competition rules. However, its interpretation and application has a significant bearing on the organisation and operation of national social security systems as well, even though the EU lacks formal competences in this field.
