Sažetak
The issue of migration, and especially illegal immigration, has always been one of the main concerns of European Union, but after the 2015 migration crisis that was caused by the war in Syria, its importance only grew in stature, as the different ideas and practices on how to handle the crisis has created a large rift between EU member states. The states that were under strongest pressure of migration currents (or at least they perceived it as such) reacted differently than the ones that were not. In turn, those states were, at best, characterized as inhospitable towards migrants, or at worst, as racists and violators of human rights. This characterization is problematic because the assumption that the idea of hospitality is the same throughout the Europe is far from the truth – different customs honed through time have produced different outcomes. We, as the peoples of Europe, share similar set of values, but those values are still highly heterogenous. Along with cultural distinctions, there is another problem with this characterization, which is in its essence, political. The concept of Empire, which Hard and Negri introduced into political philosophy at the start of millennium, is not fully appropriate for describing the current state of European Union, but it is also hard not to notice the similarities. EU also has a ‘’core’’ and ‘’periphery’’, and just like in the empire, the rule of law is in decline as we approach its outside borders. Therefore, the main aim of this paper will be to ascertain can we still endorse the idea of the law of unconditional hospitality under the shadow of our Empire, or are the conditional laws of a right to hospitality the best that we, and truly the unfortunate migrants, can hope for?
