Sažetak
Contracts of carriage of passengers by sea are frequently concluded and performed in Croatia, due to its long coastline and numerous islands. They relate both to the transport of residents and tourists along the coast and to and from the islands, as well as to the maritime transport in the broad sense - which takes place in the context of cruises and excursions, not only by ships but also boats. Unfortunately, during these transports and cruises accidents occur, causing in some cases death of or personal injury to passengers. The rules on liability for these damages exist on different levels – international, European and national. The paper will focus on only one aspect of the carriers’ liability – the issue of limitation of its liability for claims arising from personal injury to or death of a passenger. All legal sources regulating carriers’ liability contain special rules on limitation, and additionally, they allow the application of related rules on global limitation of liability for maritime claims contained, again, in several different legal sources at international and national level. The interplay between rules on special and global limitation of liability, depending on the applicable law, may result in significantly different amounts of compensation.
