Sažetak
The regulation of liability for damage caused by animals is a legal problem for which it has been attempted to find a solution since the period of the earliest law. The fundamental principles of liability established in the pre-classic sources of Roman law have to some extent been applied to the medieval statutes of our coastal towns. Differently, in the area of continental Croatia and Slavonia, as well as in the aforementioned statutes, the same principle of strict liability of the animal owner was applied for the damage caused by animals, with certain characteristics inherent in Hungarian customary law. The rules of liability were first defined and entered into the territory of continental Croatia by the provisions of the Tripartite. This research is going to seek to establish the origin of the problem of liability for damages caused by animals in Croatian medieval law and to identify possible deviations arising in the area of the aforementioned issue by the entry into force of the codification of civil law in the 19th and 20th centuries. Since the present system of Croatian law of obligations is not acquainted with the separate regulation by the analysis of comparative systems built on the same legal basis as well as with the logic of the application of the adopted earlier legal framework, it will be necessary to establish the justification for filling this legal gap.
