Sažetak
It is well known that the nature of international legal efforts to fight terrorism has experienced a substantial change after 9/11. With the United Nations Security Council Resolution 1373, and other post-9/11 Security Council's resolutions as well, the Security Council has created international anti-terrorism standards that all member states are bound to follow. However, at the same time, states have recieved a wide range of discretion in the interpretation of the respective resolutions. Not suprisingly, this resulted with some constitutional questions and implications. The aim of this paper is to analyze respective constitutional implications and the starting thesis of our research is that, in general sense, new laws adopted in individual states in order to comply with the anti-terrorism resolutions, with the focus on enhancing national security, have implications (primarily) on separation of power and protection of human rights.
