Sažetak
In recent years Europe is facing bipolarization between secular and religious/cultural approaches towards regulation of the critical fractions of the legal systems particularly in regard of the financing of the religious groups, presence of clergy in the public institutions, regulation of family life etc. European countries are dealing with growing tensions between concepts which should be adopted in the regulation of religious life which in many cases have direct connection with the moral and therefore legal values of the society. It seems that pure concept of laicized society which was shaped by French legal system was over praised and that it cannot survive in the European legal concepts which are more or less at least culturally connected with basic values of the peoples regardless of their spirituality. That was shown to be the case even in France. Religion remains important part of the everyday life and strong element of belonging to values and norms which are then shaped trough constitutions and laws of respective countries. Cases of Lautsi, Eweida and even SAS in front of the European Court of Human Rights show that religious manifestation plays and remains important part of the life in the society we live today. Advocating both more religion in the society on one hand and ‘aggressive secularism’ which doesn’t recognize any value in religious influence on the other hand, seems to be out of the request that every society should be image of the needs and demands of majority (democratic principle) and necessity to protect minority values and ways of living (human rights principle). Only by balancing the two, states should be able to make ‘good life’ to all its citizens. Erasing religion from the public sphere should not be the solution. In this presentation it will be shown that various religious groups in some parts of the Europe, including Croatia, are able to stick together and protect traditional values and concepts, while secular state remains the framework of operation. Croatia could be positive example where state grants same or similar rights to all major religious groups according to the rights which are given to the Catholic Church as the strongest and biggest community in the Country.
