Sažetak
Proportionality analysis plays a key role nowadays in the area of constitutional adjudication. The related notion of balancing, a method of solving conflicts between constitutional rights is of similar importance. Proportionality norms can be found in constitutions, and they play an important role in the practice of the constitutional courts of some legal systems. For example, Article 16 of the Croatian Constitution is an example of the so-called balancing regulating norm. The chapter deals with proportionality in the Croatian legal system through an analysis of two cases from its recent Constitutional Court practice. Besides being a descriptive endeavour, the main objective of the chapter is to compare the theory regarding proportionality and balancing by applying Alexy’s theoretical framework on the constitutional court practice to determine the degree of the connection between them in the Croatian legal system.
