Sažetak
Today, the right to the protection of personal data is a fundamental human right protected by a number of national and international legal acts. In addition, data concerning health enter the so-called special category of personal data ; additionally, protected and whose protection is specially supervised. On one hand, unauthorized disclosure of such special categories of personal data is generally sanctioned. On the other hand, health facilities are required to provide data due to the fact that the public wants to be informed about the ill (currently related to COVID-19), but also data on casualties in the event of traffic and other accidents or natural disasters. In particular, there may be legally sensitive cases in those suffering from infectious diseases, (whether to publicly announce the place of spread of the disease in order to warn other citizens), or with persons who perform the highest functions in the state apparatus. The question arises as to what kind of information the health institution may provide to the media and/or to the interested public in such cases. In this paper, we would like to list the existing legal and general practice and give recommendations for action.
