Sažetak
In this contribution, I approach the question of general principles of EU law by inquiring into contextual, institutional and strategic features of the Court of Justice’s (CJEU) jurisprudence. In my view, the neo-institutionalist theory provides very useful analytical tool for scrutinizing many elements of the EU legal system, including the case law of the Court of Justice regarding general principles. I explain how in numerous instances the Court relied on general principles with an aim of safeguarding its authority and prerogatives. In this respect, the unsubstantiated reasoning and poor justifications offered in support of the CJEU’s general principles jurisprudence are perhaps the most significant factors limiting the constructive exchange between the Union and Member States’ judiciaries.
