Sažetak
The matter of validity of Sub-Clause 20.1 under Croatian law was the subject of DAB and arbitration practice as well as, to a limited extent, judicial practice. The purpose of this paper is to take stock of the development of the law in this area. The paper addresses the issue of validity of Sub-Clause 2.1 pursuant to three different legal bases on which its validity has been disputed in practice: consistency with the fundamental principles of Croatian contract law, judicial control of unfair contract terms, and compliance with mandatory rules of Croatian law governing the prescription (limitation) periods. We conclude that, based on the current experience with the application of FIDIC 1999 Major Forms of Contract, Sub-Clause 20.1 is, in principle, considered to be enforceable in Croatian law.
