Sažetak
Today we can talk about animal law as a special branch of law. This paper emphasizes the aspects of the part of the legal order that governing private-law relations between humans and animals in Croatian law. The most controversial aspects of the civil law regulation of human and animal relations relates to the questions of the status of an animal in the law and the compensation for material and non- material damage in cases involving the killing of animals or injuring an animal integrity. This paper provides an analysis of animal status in continental European legal systems from the comparative law perspective. The authors also refer to recent judgments of Croatian courts, which contain disputable conclusions about the violation of personality rights. An analytical and critical elaboration on the theoretical and pragmatic conception of civil law regulation of certain aspects of human and animal relations will be followed by some guidelines and possible solutions de lege ferenda for resolving these controversial issues.
