Sažetak
This paper deals with one aspect of a complex matter, and there are many legal issues that also deserve to be in the focus of the professional and scientific research. In the area of indemnification liability there are particularly interesting issues (to be dealt with in our future research), such as the type of fault, premeditated fault and various forms of compensation for the damage, in particular the non-material damage, all related to crew members, shippers and maritime affairs in general. Compared with all other legal institutions liability for the damage of those who are engaged in any activity as professionals (and crew members certainly are), by a number of criteria, among the most important ones is precisely this institute (by the criterion of the value of the property in question, the number of court proceedings, the effect on the quality of work performance, conflicts of potentially relevant rights…). At the same time, those that are directly related to crew members, are very little informed on this issue. Therefore it is important to thoroughly investigate how and under what conditions these responsibilities of an individual may occur, including how and in what way liability could be excluded or at least reduced.
