Sažetak
Exercises of direct democracy are most often described, theorised and regulated as acts of public authority. That they are in this sense entangled with institutions of representative democracy is a truism. Yet what makes them particularly controversial is their unyielding bond with „the people“. It is this nexus of the instruments of direct democracy with both the mechanisms of representative democracy and the social forces within a polity that makes referendums and other forms of direct decision-making a fertile ground for generating power, particularly political power, and engendering resistance to it. It is the purpose of this paper to probe the role of Croatian direct democracy, particularly citizens’ initiatives, as a generator of political power and resistance. Starting from the premise that political power may be described rather than quantified and measured, I will revisit both the jurisprudence of the Croatian Constitutional Court and the development and enforcement of the legal framework moderating the relationship between direct and representative democracy. I will thus determine and evaluate the underlying notions of political power. In doing so, I aim to contribute to our understanding of the political in the contemporary Croatian constitutional democracy.
