Sažetak
Transparency has a special place in the European legal doctrine on private law. In the famous Max Planck Encyclopedia of European Private Law Riesenhuber and Möslein emphasize: „Transparency plays a central role in the capacity of functioning of the market economy – and the common market – however, it doesn’t function as an absolute requirement or principle. “ In contract law, transparency can be accomplished in many ways. However, it is the information duty that plays a main part in the realization of transparency in the sources of European law. The information duty is a key instrument for the protection of the weaker party in the contract. This instrument sets a duty, i.e. obligation, of the stronger contracting party to inform the co-contractor prior or during the contract conclusion in a plain and understandable manner and by using the language of the contracting party. The duty to inform the weaker contracting party about contract conditions and consequences of contract conclusion is of fundamental importance in the CJEU case law.
