Sažetak
The presentation addresses the question of theoretical justification of psychiatric seclusion and how it was implemented in practice in the Trieste asylum “Andrea di Sergio Galatti” in the period raging from 1908 until 1930. The case files that were examined were patients diagnosed with psychopathy related mental illnesses, with a focus on patient coming from Istria, and western parts of Slovenia and Croatia. The author focused on the philosophical underpinnings, the concepts ot free will, punishment justification, and moral responsibility that were used in the discussion between the classical jurisprudence school and the positivist one. Special attention was attributed to the issue of dangerousness that was used as a justification of asylum seclusion. Finally, several cases were presented in which the notion of dangerousness has been used for asylum seclusion of release and some differences between the theory and the practice were addressed.
