Sažetak
Ensuring food safety for European consumers is a top priority for EU policy makers whose goal is to achieve a high level of protection on consumers health and interests by providing a basis for informed and safe food choices. The variety of labeling legislations of single European (EU) Member States hinders legal certainty for consumers. On 25 October 2011, the European Parliament and Council adopted Regulation (EU) No 1169/2011 on the provision of food information to consumers (hereinafter: the FIC Regulation). The FIC Regulation modifies existing food labeling provisions in the Union to allow consumers to make informed choices and to make safe use of food, while at the same time ensure the free movement of legally produced and marketed food. Some aspects of the provision of information to consumers should be complemented by specific rules in order to prevent unfair business practices. The FIC Regulation brought general and nutrition labeling together into a single regulation to simplify and consolidate existing labeling legislation. The provision of detailed food information provides consumers with key information on the nature and characteristics of a foodstuff. Food information must be accurate, clear and easy to understand for the consumer. This paper also provides an overview of European regulations on the labeling of genetically modified (GM) foods. Paper will analyze also definition of Misleading Advertisement, which is given from different point of view in legal system of Croatia. Application of mentioned provision is analyzed through principle of legality and unity of legal order.
