Sažetak
The paper points to the legal framework for establishing a database of DNA data according to the latest legislation of the Serbian Parliament, with the aim of highlighting the most serious criminal offenses. The date is an analysis of the most important legal solutions to the new Law on the National DNA Register of Serbia facilitating the conduct of criminal proceedings as well as detecting the identity of perpetrators, missing or unknown persons and corpses. The DNA database includes profiles of undeniable and controversial biological samples that are the basis for forensic analysis of the collected evidence. The use of data from the DNA base aims at convicting persons who are actual perpetrators of criminal offenses as well as that legally convicted persons have an instrument available to prove their innocence. In the final part of the paper, the sensitivity of the data in the database and, accordingly, the need for their lawful processing, in particular, is shown in accordance with the positive criminal law.
