Sažetak
The issue of control over personal information released online is particularly accentuated by pervasiveness in the use of the world-wide-web to seek and find information, corresponding to recognized vital role of the Internet for the exercise of human rights and freedoms, notably freedom of opinion and expression. Internet search engines qualify as one of the most popular online services used to retrieve web-pages with relevant information corresponding to search keywords. In this presentation the author examines the pending case before the Court of Justice of the European Union (CJEU), which deals with requests for erasure of information relating to individuals from the index of web search engine’s search results. This is complemented by analysis of the rationale of individuals' right to seek erasure and blocking of their personal data according to current EU data protection legislation, and its reinforced version for the digital age (popular term: “right to be forgotten”) that is in EU legislative process. In examination of the effect and relationship of this right with other rights and freedoms, notably freedom of expression and information and the right to conduct a business, the author explores the role and liability of Internet search engines and website operators publishing and making personal data available to the public.
