Sažetak
Treatment of people declared not guilty for the reason of insanity should be in accordance with legal definitions, although this is not always the best mode of treatment. Croatia is not unique in this kind of issues as authors from developed countries state that the mode of treatment is often influenced by the organization (re-organization) of the psychiatric facilities, but also changes in legal matters. the new Act on the Protection of people with mental dysfunctions was implemented in 2015. This Act regulates the legal position of those declared not guilty for the reason of insanity, and this Act incorporated some positive changes in the mode of treatment, but also negative consequences regarding duration of treatment. After many years, this Act again incorporates outpatient forensic treatment (treatment "in freedom") from the beginning, which enables those offenders found not guilty for the reason of insanity who were in a remission during Court evaluation to be treated in a less restrictive way. The Act, whith such positive changes, also was changed in a way that shatters foundational principles of treatment in relation to the treatment duration as it limits the maximum treatment to the maximal prision sentence. New dana shows that the duration of psychiatric patients is shortened, but that there is an increase in number of forensic patients. The duration of treatment of psychiatric patients can be shortened to a certain degree, but insisting on further shortening can be contra productive. As this Act limits the duration of treatment (both inpatient and outpatient) with the maximal prison sentence, the lecture will focus on the influence of legal aspects onto the quality of treatment of forensic patients with high risk of committing a new crime.
