Sažetak
Contract of gift has been introduced as a denominated contract with the introduction of the new Law of Obligations in 2005. Until then, the legal rules of former General Civil Code has been applied to this contract. There is a long history of use of legal rules of General Civil Code for contract of gift, from 01 May 1853 to 01 January 2006. In this paper we tried to analyze questions of introduction of General Civil Code in Croatian legal system, its retention in Croatian legal system, influence of legal rules of former General Civil Code for contract of gift on development of modern Croatian system of obligations. There are many similarities between former legal rules of General Civil Code for contract of gift and lawfully rules for contract of gift in Law of Obligations ’05. But, we need to note, rules of new Law of Obligations for contract of gift follow the tradition of legal rules of General Civil Code for contract of gift, but it’s also implemented many modern regulations which are required by modern obligations requirements.
