Sažetak
The European Convention on Human Rights does not differentiate between different regions in Europe. The standards are equally applicable to so-called ‘old’ democracies and countries that have recently transitioned into democracy. Notwithstanding that, there are observable differences and different challenges in and across different parts of Europe regarding state responses to the implementation and application of the European Human Rights standards. The conference brought together academics, members of the judiciary and practising lawyers from across Europe to exchange their views on the challenges and underlying causes of insufficient compliance with the jurisprudence of the European Court of Human Rights and issues of implementation of the Convention. The workshop aimed to understand commonalities and differences across different parts of Europe on the implementation and application of the Convention. The discussion revolved around the following key issues: 1) the relationship between implementation and perceived legitimacy of the European Court of Human Rights ; 2) compliance, European consensus and the margin of appreciation ; validity of regional consensus as a factor of interpretation of European standards of human rights protection ; 3) challenges of implementation of the European Convention on Human Rights in situations of transition and recent transition. The author's presentation was focused on the challenges of implementation of the European Convention on Human Rights in Croatia, as well as other states covering the territory of the former SFRY.
