Sažetak
Today about ten percent of the world population lives in countries where voting is compulsory. Compulsory voting is an ongoing and divisive topic in legal and political science debates, particularly in countries with a low voter turnout. It is interesting to notice that these discussions are not so frequent in countries with a compulsory voting system. Moreover, while exploring the referring literature, the authors did not find persuasive and influential critics coming from the academic circles of such countries. There are arguments both for and against compulsory voting that are plausible and subtle: however, this paper is more prone to those propagating enforcement of compulsory voting. The topics related to compulsory voting are evaluated as well as is the legitimacy of states interfering with the autonomy of individuals and their rights and freedoms. Despite the fact that the authors in this view support compulsion by the state, no state intervention should be extensive. Therefore, this paper also explores the mechanisms empowering an individual’s right to choose, like conscientious objection and justified exemptions from this obligation.
