Sažetak
Origins of the legis actio per condictionem are still an unresolved matter of Roman law. Gaius' words that condicere autem denuntiare est prisca lingua in Gai. Inst. IV, 18 may indicate archaic foundations of this procedure. In this respect, its most important features are dies tricensimus, thirty days' time limit, and the use of the term condicere. They may suggest connections of this procedure with the ancient Roman religious beliefs and practices, associated with the declaration of war procedure called bellum iustum.
