Sažetak
The national report on Croatia reviews the law and practice of enforcing competition law claims before Croatian courts and arbitral tribunals. It deals first with the substantive law aspects of such claims including the applicable causes of action, the standing of the claimant, available remedies and defences and limitation periods. It then addresses the matters of jurisdiction and venue, outlines the procedure applicable before the courts, explains rules on the burden and standard of proof, production and presentation of evidence, funding and costs and concurrent proceedings. The chapter closes with an analysis of enforcement of competition law claims in arbitration and ADR processes.
