Sažetak
Traditionally CISG has been rarely applied in Croatian court practice. Many judges and attorneys have little or no awareness of the treaty and even when aware that the CISG ought to apply, judges have often ignored it. This trend is increasingly being reversed in recent practice: the Supreme Court and the High Commercial Court in their appelate decisions insist on the instruct the courts to apply CISG. By contrast, commercial courts routinely apply Croatian arbitration law, although a tendency is still present to ignore the relevant international treaties and rely exclusively on municipal arbitration law which is based on the UNCITRAL model.
