Sažetak
Most arbitration laws and rules do not require the arbitral tribunal to promote settlement. Even under the laws which do recognize such duty, it is understood that the primary function of the arbitrator is to render an award, not to broker settlements. On the other hand, it is generally accepted that it is not inappropriate for the arbitrator to ask the parties whether they have expored settlement options and inform them in general terms of the dispute resolution mechanisms which are available to them. Taking a more active approach in promoting settlement is more problematic. An arbitrator who actively encourages parties to mediate their case may come accross as partial. In order to avoid these issues, the arbitrator should be careful about actively promoting settlement where the parties have not given him mandate to do so. If the arbitrator wishes to seek such mandate from the parties, he would be well advised to refer them to some already existing set of rules.
