Sažetak
A child has the full right tp protect his or her life by providing optional medical care. Informed consent has a great value as a moral basis, essential for human relationships, the recognition of individual autonomy, dignity and the capacity for self determination. An adult patient benefits psychologically from his involvement in decision and contribution to the efficacy of treatment through his observations, perceptions and active participation. Minor patients should have the same rights. Healthcare professionals have duty to respect evolving capacity and autonomy of the child and they have to consider the views of the child in many matters including the medical decisions. The minors, according to the Croatian’ s laws, do not have capacity to decide in every legal matter, as in medical decisions until they are eighteen years old. The health care laws use to have general form for informed consent in which the parent or a guardian has to sign in behalf of a minor. According to the last supplement of the same law, there is a new informed consent form – procedure specific form. Procedure specific form does not mention under age patient, only his/her parent or guardian. The new form is created with the goal to protect the patients, to improve ethical view. But, it did not take into consideration the child’ s absence and his autonomy. The same situation is present in the Protection patient’ s right law. We will analyze these laws and try to give our perceptions and views.
