Sažetak
The aim of this paper is to focus on the specific understanding of the collective right to self- determination in the philosophical debates on immigration. Self-determination is often understood to offer a firm ground to justify a moral right of the legitimate state to exclude immigrants. It is claimed that self-determination, apart from protecting a sphere of collective self- government, requires the control over the membership composition of the collective. Without this control, which entails control over immigration, the political collective or state cannot control its character and its future development, and cannot be self-governing in the real sense. Immigrants inevitably bring new values, cultures, or political agendas in the society, which changes the way membership composition looks like, and affects policy choices which guide its political, social and economic development. I will try to show that membership control is not necessary for preserving the conditions of self-government. Self-government requires political institutions which allow members of the collective to participate in the creation and sustaining of these institutions, rules and laws which shape their collective circumstances. While these institutions can at times be imperiled by immigration, which is often framed as a threat in decline of social trust and conditions of democracy, I will argue that these situations, when they arise, may provide only a ground for a conditional, and not general right to exclude.
