Passenger Name Record (PNR) system, expansion possibilities, maritime transport, case C-817/19
Sažetak
Pointing to the most significant provisions of the European Passenger Name Record (PNR) system, the author emphasises that air carrier obligations to collect and transfer data on passengers do not also apply to maritime carriers. At the European level, the same obligation for the maritime carrier has not been standardized in terms of purpose and content, within a separate legal act, modelled on the provisions of the PNR Directive. However, the author points to certain provisions contained in the national legislation of Belgium, by which the Act on the processing of passenger data from 2016 implements the provisions of the PNR Directive in the Belgian national legislation prescribing that PNR data also be collected in relation to passengers in maritime transport when they travel from/to/through Belgium. Since the majority of EU Member States are not opposed to extending the scope of the PNR Directive on maritime transport or other transport modes, issues of a technical, financial and legal nature are pointed out in connection with the possible extension of the application of the PNR Directive on the maritime sector. The author advocates the adoption of special, uniform EU rules that will regulate in detail the scope of data that will be collected, the method of their transfer and other issues, taking into account EU data protection rules and Court of Justice of the European Union (CJEU) interpretation of some provisions of the PNR Directive in case C-817/19.
