Sažetak
Rawls' theory of justice is the subject of numerous criticisms due to the assumption of the impossibility of adequate inclusion of persons with mental impairments, either as legislators or users of the principle of justice. Martha Nussbaum's criticism is directed at the question of the legislative group and the possibility of including persons who, due to the criteria of rationality and reasonableness, are excluded from the process of forming fundamental principles. In this paper, I recognize the problems that Rawls's theory faces in the light of the aforementioned criticisms, and as a solution I propose a constructively positive interpretation of the theory of justice. Such an interpretation will allow us to expand the group of legislators through the inclusion of those individuals with mental impairments who, according to Nussbaum, are capable of participating in the selection of principles of justice. Also, the offered interpretation will include persons with the most severe forms of mental disorders in the scope of justice, in such a way as to enable them to be protected through an extended list of valid reasons for the principles of justice, which will be sensitive to the specific interests and needs of such persons.
