Sažetak
In the fight against impunity the International Criminal Court (ICC), the national courts, and the European Court of Human Rights are dividing up the work between themselves. The domestic authorities have the primary role of investigating and prosecuting large-scale violations of human rights. Only if the national authorities fail to provide adequate remedies the ECtHR is triggered into action (the principle of subsidiarity). Within its subsidiary role, the ECtHR provides normative guidance to national justice systems. However, if national authorities are unwilling or unable to act, the ICC could open its own prosecution (the principle of complementarity). In the fight against impunity, each of these judicial institutions is playing an important role, but the most important role is played by the national authorities.
