It is no novelty that EU law grants certain fundamental freedoms to those inside the EU, and not to those outside. The core of EU law is the internal market embodying four fundamental freedoms of movement, while external trade or movement is not given the same fundamental status. This chapter seeks to examine this well-known paradigm through the lens of critical theory.
