Sažetak
In this conference paper, I argued that: first, the CJEU in certain instances instrumentalises general principles, i.e. takes recourse to these highly indeterminate and vague norms with an aim of safeguarding its institutional status and constitutional prerogatives, as the neo- institutionalist theory would propose ; and second, structural characteristics of the EU judiciary make the Court unfit for a proper, i.e. transparent and coherent, engagement with general principles, which opens space for their potential misuses. The resulting inappropriate and selective Court’s methodological approach towards the general principles weakens the legitimacy of its judgments in the eyes of highest national courts, increasing the risk of constitutional clashes.
